What is Vaping?

 

Vaping is an alternative to smoking.

Vaping can be defined as the act of inhaling vaporized e-liquid through a personal vaporizer. E-liquid is generally made with 4 ingredients. Propylene Glycol is the thinning agent that helps add throat hit and evenly distribute the other 3 ingredients. Vegetable glycerin helps thicken the liquid and adds with vapor production. Next in the list is artificial and natural flavors. The flavorings range from vanilla, tobacco, mint, citrus, berry, and hundreds more. Finally, you have nicotine if indicated. These 4 ingredients are combined in different percentages to create the e-liquid you find online and in vape shops. The e-liquid can then be used in a personal vaporizer which uses a battery to apply power to a heating element found in the tank. Once the heating element reaches a certain temperature it vaporizes the e-liquid.

 

The Issue

 

August 8th, 2016 the U.S. Food and Drug Administration Final Deeming Rule went into effect. The 134-page rule contains regulations making compliance difficult, if not impossible. This will greatly affect your ability to obtain the products you need. Here is a brief overview of how some of these rules affect you as a consumer:

  • Prohibition on the distribution of free samples, you have to pay to sample flavors at vape shops.
  • Vape shops are prohibited from discussing health benefits, comparing vape products to combustible tobacco, or stating vape products are tobacco free
  • Vape shops and their employees are prohibited from assembling your device, building coils, changing your wick, or fixing and troubleshooting a device without a tobacco manufacturer’s license.

Those few points are just the beginning. The Deeming Regulations states if a product has not been on the market since February 15, 2007, they are required to submit a Premarket Tobacco Product Application (PMTA). This application may require tens, even hundreds of thousands, of dollars to be spent by manufacturers. Even with that investment, submitting their application is not a guarantee of approval. Manufacturers have until August 8, 2018 to submit their PMTA. Within the next two years, we will see many small vape businesses closing their doors. They will not survive these Deeming Regulations.
